Use of AI and Third-Party Platforms: While AI tools are widely available and can be beneficial in certain circumstances, they may have unintended consequences when used by non-lawyers.

First, confidential information you enter into an AI system may become publicly available without your consent or be used by the AI platform for other purposes.

Second, entering attorney work product, attorney-client communications, or other privileged information into AI may waive the privilege. If privilege is waived, whether inadvertently or not, this may result in the information becoming discoverable by the opposing party in your legal dispute.

Third, AI tools are susceptible to producing inaccurate, incomplete, misleading, and false answers. This can result in unnecessary time and expense debunking inaccurate AI information or correcting false impressions created by overly positive or negative analysis of legal strategy, case law, or a case’s strengths and weaknesses. The use of AI can result in conflicts between the law firm and a client that would require our firm to withdraw from representation.

For these reasons, you agree not to use AI or other third-party generative tools to communicate with the law firm, respond to our requests for information or approval of draft documents, or provide us with AI-assisted analysis, case authorities, or legal strategy, without the law firm’s prior approval.
