Court finds gaps in proof, remands contract dispute for further proceedings
DALLAS – The Fifth Court of Appeals in Dallas has reversed a $754,087.60 judgment in a breach-of-contract dispute involving Abri Health Services, LLC, sending the case back to the trial court for further proceedings.
The court held that the plaintiff failed to conclusively prove a key contractual condition required to trigger severance payments, finding no evidence in the record that a required release was executed or became effective. Without that proof, the court concluded, summary judgment was improper.
“Appellate review serves as a check on whether legal standards were met. In this case, the court recognized the evidentiary record didn’t support the summary-judgment relief awarded and remanded for further proceedings,” said managing partner Chad Baruch.
The case is Abri Health Services, LLC v. Tina Hecht and Paul Wray, No. 05-25-00194-CV.
